Your rights at work

Employee rights when working at height in the UK.

UK health and safety law gives you important rights relating to working at heights. Your employer must protect you from falls, provide proper training, supply suitable access equipment, and maintain safe systems of work.

You have the right to raise concerns about a task you have not been trained to perform safely, the right to do so without fear of negative consequences, and the right to request the equipment and protection you need to work without harm.

Falls from height are consistently the leading cause of fatal injury to workers in Great Britain, according to HSE statistics. Good working at height training is how you protect yourself - at work and for life.

This guide walks through your rights, your responsibilities and how a short Working at Heights Course can make every job above ground level measurably safer. It is theory and awareness training; practical, equipment-specific training such as MEWP or harness use may also be needed for some tasks.

Your rights in detail

Four rights every UK employee has under health and safety law

Whether you work in construction, warehousing, retail, facilities or maintenance, the Work at Height Regulations 2005 protect you in the same way.

Right to training

Your employer must make sure you are competent before you work at height, or supervised by a competent person while you learn. Training must be appropriate to your actual tasks, from stepladders to roof access.

Right to equipment

You can expect suitable, well maintained access equipment - the right ladder, platform or guardrails for the job - inspected and in good condition. Your employer must provide it.

Right to safe systems

Your employer must plan and supervise work at height properly. That includes risk assessments, the hierarchy of control, weather considerations outdoors, and protection from fragile surfaces and falling objects.

Right to report concerns

You can raise concerns about unsafe work at height without fear of negative consequences. If internal reporting fails, you can escalate to the Health and Safety Executive.

Your responsibilities

With rights come duties.

While employers carry primary responsibility for workplace safety, employees also have legal duties under the Health and Safety at Work etc. Act 1974. You must take reasonable care of your own safety and that of anyone affected by your actions at work.

  • Use equipment as you were trained to use it
  • Check ladders and platforms before every use
  • Follow the safe system of work and any exclusion zones
  • Report defects, damaged equipment and near-misses
  • Never overreach, overload or improvise at height

What to do

If something goes wrong at work.

If your employer asks you to work at height but has not provided training, politely point this out and ask when training will be provided. Document your concerns in writing if needed, and contact the HSE if they are not addressed.

If you have already suffered an injury, report it to your employer immediately, seek medical attention, ensure the injury is logged in the accident book, and consider seeking legal advice for serious injuries.

Understanding Working at Heights Training

Working at Heights Training teaches you how to work safely anywhere a fall could cause injury. A good course covers:

  • Legal framework - understanding UK health and safety law, the Work at Height Regulations 2005 and your rights.
  • Hazard awareness - falls from ladders, roofs and platforms, fragile surfaces, falling objects and weather.
  • The hierarchy of control - avoid work at height where possible, prevent falls, minimise consequences.
  • Equipment knowledge - choosing and checking ladders, stepladders, platforms and other access equipment.
  • Emergency procedures - what to do when something goes wrong, including rescue planning.

Good working at height training empowers you to protect yourself. The checks and safe practices you learn can prevent falls that would otherwise change your entire working life.

Can I complete training myself?

Yes. While employers should provide or arrange training, you can also complete a Working at Heights Course independently. This is useful if you are job seeking and want to arrive ready, your current employer has not yet organised training, you want to refresh your knowledge, or you work in a casual or contract role. Remember that practical, equipment-specific training - MEWPs, tower scaffolds, harnesses - may also be legally required for some tasks.

Our online course costs £19.97 and provides an instant certificate on passing. Many job seekers complete the course to improve their employability in construction, warehousing, facilities management and maintenance.

How to protect yourself at work

Beyond formal training, these practical steps protect you from falls at work:

  1. Plan ahead - think before you climb. Can the job be done from the ground? Is this the right equipment?
  2. Choose the right kit - match the ladder, platform or tower to the task, the duration and the location.
  3. Inspect before use - check stiles, rungs, feet, locks and platforms for damage every time.
  4. Set up properly - firm, level ground, correct ladder angle, secured where possible.
  5. Keep three points of contact - on ladders, and never overreach. Move the ladder instead.
  6. Watch the conditions - wind, rain and ice change everything outdoors. Stop if conditions turn.
  7. Protect people below - secure tools and materials, and respect exclusion zones.
FAQ

Questions UK employees ask, answered.

Clear answers on training cost, raising concerns, refresher timing and health conditions.

Does my employer have to pay for my Working at Heights Training?
Yes. If your employer requires you to work at height, they must provide training at no cost to you. Training should also take place during working hours where possible.
Can I refuse to work at height without training?
You can raise concerns about doing work you have not been trained for. Under the Work at Height Regulations 2005, work at height must be carried out by competent people or under the supervision of a competent person. Communicate respectfully with your employer about the need for training. You should not be penalised for legitimate safety concerns.
How often do I need refresher training?
The standard recommendation is every 3 years, though some employers refresh more often in higher-risk work. Your certificate is valid for 3 years from the date of issue.
What if a health condition affects my work at height?
You should tell your employer about any condition that could affect your safety at height, such as vertigo, blackouts, or medication that causes dizziness. Your employer should consider this in their risk assessment and may need to adjust your duties or provide additional controls.
