Understanding your legal obligations

The primary legislation governing work at height in the UK is the Health and Safety at Work etc. Act 1974, supported by the Work at Height Regulations 2005 (WAHR 2005) and the Management of Health and Safety at Work Regulations 1999. The HSE publishes practical guidance on safe work at height for employers and workers.

These regulations apply to any workplace where employees work at height. This covers many sectors - construction, warehousing, retail, hospitality, facilities management, agriculture, education, transport and many more.

What counts as work at height?

Work at height is work in any place where, without precautions, a person could fall a distance liable to cause injury. It includes:

• Working on ladders and stepladders
• Working on roofs, including flat roofs and near rooflights
• Working on scaffolds, tower scaffolds and MEWPs
• Working near open edges, openings or excavations
• Working above fragile surfaces or where objects could fall on others

There is no minimum height in the regulations. A fall from a low stepladder can cause serious injury, which is why planning, equipment selection and training matter at every level.

Consequences of non-compliance

The Health and Safety Executive (HSE) actively enforces these regulations. Inspectors can visit your workplace without notice and may take enforcement action if they find non-compliance:

1. Improvement Notice - requires you to address specific failings within a set timeframe.
2. Prohibition Notice - requires immediate cessation of hazardous activities until issues are resolved.
3. Prosecution - for serious breaches, employers and individuals face criminal prosecution, unlimited fines and, in extreme cases, imprisonment.

Implementing a working at height training programme

Step 1: Identify who needs training

Assess your workforce to identify all employees who work at height. This may include more staff than you initially think - anyone who climbs a stepladder to restock a shelf, accesses a mezzanine, clears a gutter or changes a light fitting needs the right knowledge.

Step 2: Provide appropriate training

All identified workers should receive training that covers the risks from working at height, the hierarchy of control (avoid, prevent, minimise), how to select and check access equipment, the dangers of fragile surfaces and falling objects, and what to do in an emergency.
